Terms & Conditions

1. Introductory Provisions

 

These Terms and Conditions (hereinafter: the "Terms") define the conditions of purchase, the rights and obligations of the customer (hereinafter: the "User"), and the Seller, and regulate the mutual relationship between the Seller and the User.

By confirming an order, the User declares that they are familiar with the entire Terms, understand them, and fully accept them.

2. Ordering and Contract Formation

 

 

Purchase Procedure

 

  1. Product Selection: The User selects the item, specifies the quantity, and adds it to the cart.

  2. Order Submission: The User completes the delivery form, selects the payment method, and confirms acceptance of these Terms and the Privacy Policy.

  3. Order Confirmation: Upon submission, the User receives a confirmation email. The contract of sale between the Seller and the User is thereby irrevocably concluded.

  4. Production and Shipment: The items proceed to production in the [Czech Republic]. Once manufactured, the Seller dispatches the goods and notifies the customer with a tracking number.

 

Custom-Made Product Disclaimer

 

Since the items are custom-made immediately upon order, there may be minimal deviations in colours and dimensions compared to those displayed on screen. The Seller strives for the most realistic presentation possible.

 

3. Prices and Payment Terms

 

 

Prices

 

All prices are stated in [EUR] and include VAT. Prices are valid at the moment the order is placed and do not have predetermined validity.

 

Shipping Costs

 

Shipping costs are calculated and added to the total order value at checkout. The price depends on the weight, dimensions, and destination country.

 

Methods of Payment

 

The Seller accepts the following payment methods:

  • Payment via PayPal

 

4. Delivery and Shipping

 

 

Origin and Delivery Time

 

  • Shipment Origin: [Czech Republic].

  • Processing (Production) Time: Items are custom-made, so the time required for production, quality check, and preparation for dispatch is typically 1-2 business days.

  • Delivery Time: After dispatch, the estimated delivery time for EU Countries is 2–8 business days, and for Northern Europe/Remote Areas it is 4–15 business days.

  • The Seller is not responsible for delays caused by the courier service.

 

Damages and Loss

 

The User is obliged to check the integrity of the goods upon receipt. In case of a damaged parcel, the User must file a claim directly with the delivery service and simultaneously notify the Seller at luhovibe@yahoo.com.

 

5. Right of Withdrawal (Returns and Refunds)

 

 

Right to Withdraw Without Stating a Reason (EU Consumers)

 

The consumer has the right to notify the Seller in writing that they withdraw from the contract within 14 days of receiving the goods, without having to state a reason for their decision.

  • The notification of withdrawal must be sent to the User at the email address: luhovibe@yahoo.com.

  • The goods must be returned no later than 14 days after the User sends the notice of withdrawal.

 

Return Costs and Refund

 

  • Return Costs: The direct costs of returning the goods shall be borne by the User (unless the goods are faulty).

  • Refund: All payments received (including delivery costs, except for additional costs if the customer chose a more expensive shipping method) will be returned by the Seller no later than 14 days after receiving the returned goods or proof that the customer has sent them back.

 

Exceptions for Custom-Made Items

 

The right of withdrawal does not apply to goods that are made according to the consumer's exact instructions and adapted to their personal needs (e.g., with a personalized name or message that prevents resale). Returns in these cases are only possible if the product is defective or damaged.

 

6. Statutory Warranty (Defective Goods)

 

The Seller is liable for material defects that the goods had when the risk passed to the buyer.

 

Claiming a Material Defect

 

The User can exercise their rights if they notify the Seller of the defect within two months from the day the defect was discovered.

  • The defect is considered material if specific legal criteria, e.g., the item does not have the characteristics necessary for its normal use or for the circulation.

  • The User must allow the Seller to inspect the item.

 

7. Privacy Policy

 

The Seller protects all personal data of Users in accordance with the General Data Protection Regulation (GDPR) and Slovenian national legislation. Details on data processing are available in the Privacy Policy.

8. Final Provisions and Dispute Resolution

 

These Terms and Conditions are governed by the laws of the Republic of Slovenia and the relevant EU legislation.

  • The parties shall endeavour to resolve any disputes amicably.

  • If an amicable solution is not possible, the dispute shall be resolved by the competent court in Ljubljana, Slovenia.
